When Do I Need A Building Permit?

The Building Regulations recognise that some building work is of a minor nature, in that the protection's and advantages that a Building Permit can provide are not necessary or will not be achieved. In these cases, the Building Regulations may exempt property owners from having to obtain a Building Permit.

As part of the Building Regulations, Building Permit requirements are now based on the scope of building work rather than the previous $5,000 limit, implying the need for garages, carports and pergolas to have a Building Permit.

You may not require a Building Permit if your project fits into the following criteria:

Repair work done for maintenance purposes (ie. replacing rotted weatherboards); and construction or demolition of some BCA Class 10 Buildings (non-habitable outbuilding) or alterations to any other building type, if the building work -

- Does not adversely affect the structural soundness of any building or attached to an existing building or structure; and/or
- Does not adversely affect the safety of the public or occupiers of any building; and/or
- Does not project beyond the street alignment; and/or
- Is not work carried out on, or in connection with a Historical building; and/or
- Does not involve construction over an easement; and/or
- Is not work related to Essential Services such as Fire Sprinklers, Smoke Detectors and Alarms, Fire Rated structures, etc.

It is your responsibility as the property owner/s to ensure that a Building Permit is in place prior to commencement of building works or guarantee that the proposed works are exempt under the Building Regulations from requiring a Building Permit.

Important notes

- Paving, concreting, landscaping (unless the work includes a retaining wall greater than 1 meter in height or when a Building Permit is required) are not included in this definition.
- Building works ‘cost’ must include the value (ie. market trade rate) of labour and materials.
- Guidance to determine ‘cost’ can be obtained from relevant Quantity Surveying or estimating groups including MBA & HIA.
- Works that do not require a Building Permit may require other approvals from the Councils, eg. Town Planning, Health Departments, Local Laws. All relevant departments should be contacted prior to commencement of works.

IMPORTANT Irrespective of whether a Building Permit is required or not all building works must comply with the Building Act 1993, Building Regulations 2006, Building Code of Australia and all associated Australian Standards.
