TERMS OF AGREEMENT
Additional
Consultants:
The estimated fee/quotation does not include payment for the services of any other consultant(s)/legislated bodies that may be recommended in support of the proposal (e.g. applications to the Building Commission for Modifications, the preparation and submission of Council Dispensations, Report and Consents, deposits and/or securities required by government bodies, written Town Planning confirmation from Council, referrals/recommendations to Fire consultants, etc). Where additional expert services are recommended, discussions will be held and approval obtained from the client(s) before proceeding, and the formal engagement and payment of such experts will be the responsibility of the client(s).
Disbursements:
The amount quoted/charged is not inclusive of costs incurred in exceeding the mandatory Building Inspections as called for and listed on the Building Permit, the need to issue staged Building Permits or Variations. Such costs will be deemed as disbursements that must be paid in addition to the initial estimated charge and will be separately itemized on an additional Tax Invoice.
BUILDING NOTICES AND ORDERS:
Building Notices and Orders are formal documents prescribed under the Regulations when breaches / non-compliances are identified for the purpose of securing compliance with Permit documents and relevant provisions of the Regulations. Notices and Orders are required to be served as a matter of course, for significant areas of non-compliance or where safety is or may be comprised.
In the case of routine rectification works an Inspection Report/Building Direction or letter will normally be sent to the owner and/or builder as applicable. In the event of no response within an appropriate time (ie. 7, 14 or 30 days) a Building Notice may be served and further fees will be applicable.
Access to
Site:
The client must ensure all necessary stamped approved Permit documents to be made available, as well as access to the site on the day of the arranged mandatory inspection/s.
Payment
of Fees:
Under Schedule 2 of the Building Act 1993, the fee for Building Surveying Services must be paid prior to the issue of the Building Permit. Please Note: A Building Permit will not be issued until payment has been made.
Time and
Liability:
A Quote is valid for a period of three months from the date of issue, and is conditional upon the lodgement of the Building Permit application within this time; and is based on the cost of works provided at the time of the quote request. An additional invoice or amended quote will follow where building works and costs exceed that quoted.
